The court fined "Sahiyya TV" channel on the basis of a protocol drawn up by the Audiovisual Council

 

During the monitoring of programs of "Sahiyya TV" channel of "Sahiyya TV" LLC, which is a platform broadcaster, not performing satellite transmission, conducted by the Audiovisual Council of the Republic of Azerbaijan, facts of violations of the Article 4.3 of the Law of the Republic of Azerbaijan "On Advertising" (Goods, the production (sale) of which is licensed, certified, can be advertised only in the presence of relevant supporting documents.  In this case, the license and certificate number, the date of issue and the name of the issuing authority must be indicated in the advertisement). Thus, in the advertisements of medical facilities broadcast on the channel on June 7, 2024 at 20:00 and on June 8, 2024 at 08:00, the license and certificate number of these medical facilities, the date of issue and the name of the issuing authority were not indicated.

In this regard, on June 08, 2024 the Audiovisual Council of the Republic of Azerbaijan drew up 2 protocols on administrative offences and according to the requirements of Article 43.1 of the Code of Administrative Offences sent them to the relevant court. On June 27, 2024, the Nasimi District Court reviewed the cases and by the relevant decisions of the Court "Sahiyya TV" LLC was fined in total 16000 manats, 8000 manats for each administrative offence.

On 16 August 2024, the Baku Court of Appeal upheld the decisions of the Court of first instance and they entered into legal force.
