PLATFORM BROADCASTER NOT PERFORMING SATELLITE TRANSMISSION

 

Platform broadcaster not performing satellite transmission is a natural or legal person responsible for the content of audiovisual programs and broadcasts them within packages of platform and (or) multiplex operators or directly over the internet.

Platform broadcaster not performing satellite transmission can broadcast its programs without changing their content on its internet information resource (website) and other video sharing platforms.

The editorial office of a platform broadcaster not performing satellite transmission shall operate in the territory of the Republic of Azerbaijan and broadcast at least 6 hours a day.

Platform broadcaster not performing satellite transmission can conduct advertising activities having fully ensured the use of the state language in its programs which broadcast during prime time (prime time for television and radio broadcasting are determined by the Audiovisual Council of the Republic of Azerbaijan).

In addition to the above-mentioned requirements, the platform broadcaster operating directly over the internet, shall have a website and a certain program schedule and broadcast from its own website.

The following documents shall be submitted to the Audiovisual Council of the Republic of Azerbaijan in order to obtain the license of platform broadcaster not performing satellite transmission:

If the applicant is a natural person:

  • Cover letter addressed to the Audiovisual Council of the Republic of Azerbaijan, signed and sealed by a natural person or an authorized representative;
  • Application signed and sealed by a natural person or an authorized representative;
  • Copy of the taxpayer's registration certificate;
  • Copy of the natural person's identity document; information on address of registration and actual residence, as well as contact details of the natural person;
  • Consent form signed by natural person, permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Copy of the identity document of the head of the management body (CEO, director, executive director, general manager); an information on address of registration and actual residence, as well as contact details of the head of the management body (CEO, director, executive director, general manager);
  • Consent form signed by the head of the management body (CEO, director, executive director, general manager), permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Notarized copy of the document on higher education of the head of the management body (CEO, director, executive director, general manager);
  • Name of the channel (editorial office); electronic version of logo/emblem in JPEG/JPG format image with minimum resolution 600x600dpi;
  • Copy of the identity document of the editor-in-charge (editor, editor-in-chief, director, etc.) of the channel (editorial office); information on address of registration and actual residence, as well as contact details of the editor-in-charge (editor, editor-in-chief, director, etc.) of the channel (editorial office);
  • Business case (broadcasting concept, target audience, talent and human resources, information on technical capabilities (equipment) for broadcasting etc.) signed and sealed by the natural person or his authorized representative;

 

If the applicant is a legal person:

  • Cover letter addressed to the Audiovisual Council of the Republic of Azerbaijan, signed and sealed by an authorized representative of a legal person;
  • Application signed and sealed by an authorized representative of a legal person;
  • Notarized copy of the extract from the state register of legal person;
  • Notarized copy of the Charter of a legal person;
  • Copy of the taxpayer's registration certificate of the legal person;
  • Copy of the identity document of the founder (founders) and/or shareholder (shareholders) of the legal person; information on address of registration and actual residence, as well as contact details of the founders and/or shareholders of the legal person;
  • Consent form signed by the founder (founders) and/or shareholder (shareholders) of the legal person, permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Notarized copies of the extract from the state register and the Charter of the legal person (persons), who is the founder or shareholder of the legal person;
  • Copy of the identity document of the head of the management body (CEO, director, executive director, general manager); an information on address of registration and actual residence, as well as contact details of the head of the management body (CEO, director, executive director, general manager);
  • Consent form signed by the head of the management body (CEO, director, executive director, general manager), permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Notarized copy of the document on higher education of the head of the management body (CEO, director, executive director, general manager);
  • Name of the channel (editorial office); electronic version of logo/emblem in JPEG/JPG format image with minimum resolution 600x600dpi;
  • Copy of the identity document of the editor-in-charge (editor, editor-in-chief, director, etc.) of the channel (editorial office); information on address of registration and actual residence, as well as contact details of the editor-in-charge (editor, editor-in-chief, director, etc.) of the channel (editorial office);
  • Business case (broadcasting concept, target audience, talent and human resources, information on technical capabilities (equipment) for broadcasting etc.) signed and sealed by the natural person or his authorized representative.

 

The submitted documents shall be considered by the Audiovisual Council of the Republic of Azerbaijan within 10 (ten) working days from the date of registration and a decision to issue or refuse to issue a license shall be made.

Persons broadcasting audiovisual programs directly over the internet may obtain platform broadcaster license only upon their application.
