The Court fined the public broadcaster ("ITV" channel) on the basis of a protocol drawn up by the Audiovisual Council

 

The fact of violation of legal requirements was revealed in the program "1 city & 24 hours" broadcast on May 04, 2024 on the "ITV" television channel (The Public Television and Radio Broadcasting Company) from 13:00 to 13:24. The fact that during the program the presenter described the features of the alcoholic drink on the table and recommended its consumption during a visit to the city falls within the category of information prohibited for distribution to children, as information that "promotes actions that may pose a potential threat to the life and safety of children", according to Article 4.2.3 of the Law "On Protection of Children from Harmful Information". According to Article 9.3 of this Law, when "18+" information product is broadcast on television and radio, a warning regarding the age category of this information product must be accompanied by a visual symbol in the case of television broadcasting and by an audio signal in the case of radio broadcasting.

The "ITV" television channel did not comply with the specified legal requirements during the broadcasting of the program, thereby violating the provisions of the Law of the Republic of Azerbaijan "On Protection of Children from Harmful Information". In this regard, on August 02, 2024 the Audiovisual Council of the Republic of Azerbaijan drew up a protocol on administrative offence and according to the requirements of Article 43.1 of the Code of Administrative Offences sent it to the relevant court. On August 13, 2024 the case was heard by the Yasamal District Court, and the Public Television and Radio Broadcasting Company was fined in the amount of three thousand manats by the relevant decision of the Court.
