UNIVERSAL PLATFORM OPERATOR

 

Universal platform operator is a natural or legal person that retransmits programs, including on-demand broadcasting services through cable, IPTV, OTT, mobile TV and encrypted satellite transmission signals. Universal platform operator can perform retransmission through 2 or more of the abovementioned methods simultaneously.

Universal platform operator sells programs of foreign audiovisual broadcasters to the user under the agreement. Universal platform operator also can retransmit the programs of the platform broadcaster under the agreement.

Universal platform operator shall include programs of all nationwide terrestrial television broadcasters in its retransmission packages.

Universal platform operator shall submit to the Audiovisual Council of the Republic of Azerbaijan a copy of the agreement concluded between it and a foreign audiovisual broadcaster or a person authorized to conclude the agreement on its behalf for the retransmission of the programs of the foreign audiovisual broadcasters.

The following documents shall be submitted to the Audiovisual Council of the Republic of Azerbaijan in order to obtain universal platform operator's license:

If the applicant is a natural person:

  • Cover letter addressed to the Audiovisual Council of the Republic of Azerbaijan, signed and sealed by a natural person or an authorized representative;
  • Application signed and sealed by a natural person or an authorized representative;
  • Copy of the taxpayer's registration certificate;
  • Copy of the natural person's identity document; information on address of registration and actual residence, as well as contact details of the natural person;
  • Consent form signed by natural person, permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Copy of the identity document of the head of the management body (CEO, director, executive director, general manager); an information on address of registration and actual residence, as well as contact details of the head of the management body (CEO, director, executive director, general manager);
  • Consent form signed by the head of the management body (CEO, director, executive director, general manager), permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Notarized copy of the document on higher education of the head of the management body (CEO, director, executive director, general manager);
  • Name of the operator’s service; electronic version of logo/emblem in JPEG/JPG format image with minimum resolution 600x600dpi;
  • Business case (list of the channels planned to retransmit, area/ region of operation, talent and human resources, information on technical capabilities (equipment) for retransmission etc.) signed and sealed by the natural person or his authorized representative;

 

If the applicant is a legal person:

  • Cover letter addressed to the Audiovisual Council of the Republic of Azerbaijan, signed and sealed by an authorized representative of a legal person;
  • Application signed and sealed by an authorized representative of a legal person;
  • Notarized copy of the extract from the state register of legal person;
  • Notarized copy of the Charter of a legal person;
  • Copy of the taxpayer's registration certificate of the legal person;
  • Copy of the identity document of the founder (founders) and/or shareholder (shareholders) of the legal person; information on address of registration and actual residence, as well as contact details of the founders and/or shareholders of the legal person;
  • Consent form signed by the founder (founders) and/or shareholder (shareholders) of the legal person, permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Notarized copies of the extract from the state register and the Charter of the legal person (persons), who is the founder or shareholder of the legal person;
  • Copy of the identity document of the head of the management body (CEO, director, executive director, general manager); an information on address of registration and actual residence, as well as contact details of the head of the management body (CEO, director, executive director, general manager);
  • Consent form signed by the head of the management body (CEO, director, executive director, general manager), permitting to obtain personal data of a special category (convictions for grave offences or especially grave offences, as well as crimes against public morality, outstanding and unexpunged convictions);
  • Notarized copy of the document on higher education of the head of the management body (CEO, director, executive director, general manager);
  • Name of the operator’s service; electronic version of logo/emblem in JPEG/JPG format image with minimum resolution 600x600dpi;
  • Business case (list of the channels planned to retransmit, area/ region of operation, talent and human resources, information on technical capabilities (equipment) for retransmission etc.) signed and sealed by the natural person or his authorized representative.

 

The submitted documents shall be considered by the Audiovisual Council of the Republic of Azerbaijan within 10 (ten) working days from the date of registration and a decision to issue or refuse to issue a license shall be made.
